General Terms and Conditions

Crankworx Rotorua - Event Ticket Terms and Conditions

Please read these entire terms (“Terms”) carefully before signing (or, in the case of online ticket purchase, by electronically purchasing a ticket). Each ticket purchaser (“you, your, I, me”), must sign or agree to these Terms & Conditions.



I acknowledge and agree as follows:



All pricing is displayed and charged in New Zealand dollars and includes relevant taxes (booking fees apply). Crankworx Rotorua (including Mountain Bike Events Limited and Crankworx Events Inc) (“Crankworx Rotorua, we, us, our”) reserves the right to alter published prices at any time.



1. Defined Terms

1.1 “Force Majeure Event” means any event or cause beyond the reasonable control of a party, including but not limited to, interruption or prevention by any riot, governmental order or regulation; labour strikes beyond the reasonable control of the parties; acts of war; acts of terrorism; fire; flood; adverse weather conditions; drought; natural disaster; pandemic; epidemic; infectious disease or virus or any other event commonly referred to as an “Act of God”, and any adverse movement, or the announcement by the Government of an impending adverse movement of New Zealand’s COVID response.”



2. Alterations to Dates/Schedule

2.1 We reserve, in our absolute discretion, the right to alter the dates/schedule of the Event or cancel any Event and will use all reasonable endeavours to provide you with reasonable prior notice of the change of date or cancellation.

2.2 We reserve the right to add, withdraw, or substitute any riders, performers, or activities associated with the Event.



3. Force Majeure Event

3.1 We will not be in breach of any of our obligations to you under these Terms because of any failure on our part directly or indirectly due to a cause beyond our reasonable control, including a Force Majeure Event.



4. Consumer Guarantees Act 1993

4.1 If you buy, or claim to buy a ticket for business purposes, the Consumer Guarantees Act 1993 will not apply. This does not change the rest of these terms which remain valid.



5. Anytime Tickets

5.1 Anytime tickets are valid for any day of the festival.

5.2 The event program is subject to change and no flexibility can be given to anytime tickets if the event of choice is postponed or cancelled (refer to section 2 and section 6).

5.3 Purchasers of Family ‘Anytime’ Tickets must arrive as a collective.



6. Cancellation and Refunds

6.1 Except as set out in clause [5.2 and 5.3], or any explicit refund policy on the ticketing platform, we will not refund payments made by you for tickets under any circumstances, including:

(a) The non-appearance of a particular person or team (whether advertised or not);

(b) Any variation to the on-track Event program;

(c) Any variation to the off-track Event program, services, and attractions such as the postponement or cancellation of any entertainment, amusements, or interactive displays;

(d) Any adverse weather conditions;

(e) If your personal circumstances change;

(f) Any other circumstances beyond our reasonable control, including a Force Majeure Event, such as, fire; flood; store; adverse weather conditions; drought; natural disaster.

6.2 Re-scheduled/Cancelled Event: If the entire Event is rescheduled or cancelled, subject to clause [5.4], we will either (at our option):

(a) Exchange the ticket for a ticket to the rescheduled or next Event; or

(b) If we are required to provide a refund by law, then subject to a refund request being received by us in accordance with clause [5.5], we will refund the ticket price (less all reasonable costs and expenses including booking fees, credit card fees, courier fees, advertising costs, hire fees etc)).

6.3 Partial Refund: If part of the Event is cancelled and cannot be rescheduled; subject to clause [5.4], we will either (at our option):

(a) Provide a proportionate credit to the ticket-holder for the next Event; or

(b) If we are required to provide a refund by law, then subject to a refund request being received by us in accordance with clause [5.5], we will refund the proportion of the unused ticket (less all reasonable costs and expenses including booking fees, credit card fees, courier fees, advertising costs, hire fees etc).

6.4 No Refund if No Payment: If no monetary consideration has been paid for a ticket, no refund or other costs will be payable to the holder of such ticket in the event of cancellation, postponement or change to the Event, or for any reason whatsoever.

6.5 Refund request process: For all tickets, email rotorua@crankworx.com with your contact details, and all ticket transaction information. If you are eligible for a refund, we will make the refund payment to the credit card that the tickets were purchased with. If the credit card you used to purchase has expired, please note this in the email and our representative will contact you for new details. If you purchased a ticket using EFTPOS or cash then please provide bank details so we can refund you directly. Please do not provide credit card details in emails. Proof of purchase will be required for any refund or exchange. Bank refunds will only be made to New Zealand bank accounts.

6.6 Refund Request Timeframes: Subject to consumer legislation, no refunds for tickets will be given if a refund request is made after 2 months from the date the Event was scheduled or 2 months of the re-scheduled Event date being advised.

6.7 Liability: To the maximum extent permitted by law, in no event shall we be liable to you under or in connection with these Terms, and/or in relation to your participation or non-participation in the event, and/or in relation to the supply of the Tickets (whether in contract, tort or otherwise) for consequential losses or damages, indirect loss or any economic loss or loss or profits (including flights, accommodation and travel costs). To the fullest extent permitted by law, we will not be liable for any loss or damage (including indirect or consequential loss or damage) suffered as a result of, or arising from, or in any way connected to the cancellation, postponement or change to the Event (or any part of the Event) or for your participation or non-participation in the event. If for any reason, we are liable to you, our maximum liability shall be equal to the ticket fee paid by you for the relevant event.



7. Lost Tickets

7.1 In the case that tickets are damaged, lost or stolen, Crankworx Rotorua and/or the seller will consider replacing the ticket on the proviso that proof of purchase can be provided and that there is sufficient time to arrange a replacement.



8. Disorderly Behaviour

8.1 Individuals or groups involved in disorderly conduct will be escorted from the venue and tickets will be made invalid for the remaining days of the event. This may include the use of foul language, fighting, abuse of other patrons, or any other activities that are seen to impede the event in any way.



9. Lost Property

9.1 Any property found to be misplaced or lost onsite at the event will be returned to the Skyline Rotorua Gondola Terminal for collection.



10. Dangerous/Prohibited Goods

10.1 Dangerous/Prohibited Goods include, but are not limited to: Fireworks, glass bottles and cups, alcohol, knives, weapons of any sort. Goods intended for sale. Unauthorised products intended for giveaways. Drones (unless the patron also has written consent for use from Crankworx Management).

10.2 Patrons will be subject to a bag check on entry to the venue. Any items deemed to be potentially dangerous or prohibited will be confiscated and disposed of by security personnel. Confiscation of goods may also lead to expulsion of the patron from the venue.

10.3 Alcohol Consumption:

(a) The venue is a licensed premises.

(b) Bringing alcohol into the venue is strictly prohibited.

(c) Alcohol will not be served to underage patrons.

(d) The liquor licensee (Skyline Rotorua) has a legal requirement to exclude or remove intoxicated patrons.

(e) Conditions of entry will be strictly enforced.

(f) Patrons may be asked to present current photo ID or a NZ Driver’s License as proof of age from time to time.



11. Drone Policy

11.1 Skyline Rotorua is a restricted airspace with aerial cableways therefore the use of drones is not permitted at the event. This policy extends to any event venues outside the Skyline Rotorua. In special cases, a permit to fly a drone may be granted provided that the user has received permission from the Crankworx Rotorua Management, and Civil Aviation Authority. Crankworx Rotorua Management have established a process for facilitating the use of drones. Please email rotorua@crankworx.com for more information.



12. Animal Policy

12.1 Except as set out in clause [11.3], animals are not permitted on-site of Crankworx Rotorua or Skyline venues.

12.2 For the purposes of this policy “Animal” means any bird, reptile, or mammal.

12.3 Exceptions: Assistance animals trained to assist a physically impaired person in one or more daily life activities, including but not limited to Guide Dogs for the Blind, Companion Dogs for the Deaf, Canine Companions for Independence, or those associated with a comparable nationally recognised organisation.



13. Premium Passes

13.1 Premium Passes for individual sessions are non-transferable to other days or other products and services.

13.2 If a Premium session is rescheduled, the Premium Pass for the original session purchased will be valid for the rescheduled date and time.

13.3 Complimentary drink tickets must be used on the day for which they are issued.

13.4 Drink tickets will only be issued once. If a drink ticket is issued for a Premium session and that session is subsequently postponed, access to the Premium Zone will be transferred to the rescheduled date/time but drink tickets will not be reissued.



14. Gondola and Luge

14.1 Single Day Passes (Adult, Child, and Family inclusive) do not include complimentary gondola uplift with any ticket purchase. Multi Day Passes (Adult, Child, and Family inclusive) do include complimentary gondola uplift for each ticket holder throughout the duration of the Skyline event (20 – 24 March 2024, inclusive).

14.2 Please note that age/height restrictions apply for children to ride the Luge and Chairlift solo.

14.3 Luge rides are subject to a strict code of conduct. The Luge Code of Conduct is displayed at the top of the chairlift before the start zone.

14.4 Height restrictions apply to accompanied children.

14.5 Skyline reserves the right to refuse entry and may ask those who break the code of conduct to leave without refund.



15. Risk to spectators

15.1 The events that take place as part of Crankworx Rotorua include an element of risk to riders and potentially spectators. The event organiser will take all practicable steps to reduce risk to athletes by ensuring that risks are eliminated, minimised or isolated wherever practicable and in accordance with the Crankworx Rotorua Safety Management System. It is expected that spectators will obey all event signage and will refrain from crossing barriers that are provided for their personal as well as rider safety.



16. Image Use

16.1 As a condition of attending the event, the ticket holder grants the Event organisers all the necessary authority, right and license and permission to use photographs, audio or video recordings, or other forms of recordings that capture the attendees image, likeness, voice or performance (or all of these) (collectively hereinafter referred to as “Images”), in which he/she may be included in whole or in part, in any manner or media, including print, broadcast, internet media, direct marketing channels, downloadable content and applications, and all other technologies now known or hereafter developed. The Images may be used or exploited for any commercial or non-commercial purpose whatsoever, and may be altered, modified, changed, combined or incorporated into other works. No fees or other compensation whatsoever will be provided to spectators for or in connection with the use of the Images.
